The High Court has ordered a fresh disposal of a case after an administrative lapse revealed that a matter marked as "disposed" on the e-Court website lacked a final signed judicial order. The original petitioner, by filing a writ petition before the High Court, raised a grievance that an order dated March 31, 2026, was missing from the physical files of the North Goa Principal District and Sessions Court. Mysteriously, the case had already been updated on the official e-Court platform as "disposed." Noting the serious discrepancy, the High Court had earlier directed the Principal District and Sessions Judge on May 6, 2026, to submit an inquiry report explaining the order's non-availability. During the hearing before the High Court, a report dated May 20, 2026, submitted in a sealed envelope by the North Goa Principal District and Sessions Judge, was opened in open court. The internal inquiry revealed a series of systemic lapses: the then-presiding officer of the District Court had only partly dictated and partly handwritten the order before the case was marked disposed on March 31, 2026. The concerned stenographer stated that while the handwritten portions were later typed for proofreading, the final printed copy was never signed by the judge. The civil in-charge reported that when the case file was received on April 6, 2026, it contained only a photocopy of the incomplete, mixed-text order. As a result, the finalized order could not be uploaded to the portal. Taking note of that report, the High Court observed: "A plain reading of the said report indicates that no such order has been signed by the presiding officer who heard the matter before the District Court, but only partly dictated and partly handwritten." Recognizing that a case cannot legally be treated as resolved without a valid signed judgment, the High Court directed the Principal District and Sessions Judge, North Goa, to assign the matter to a competent-jurisdiction judge for a complete rehearing. The High Court also fast-tracked the process, directing the newly assigned court to take the matter up in its first sitting on July 7, 2026. The judge has been ordered to decide and conclude the rehearing within two months.
